Microsoft has lodged an appeal against its $1.3 billion (£680 million) fine issued by the anti-trust commission.
Jack Evans, a spokesman for the computing giant, confirmed that an appeal had been lodged with the court of first instance in Luxemburg.
"We are filing this appeal in a constructive effort to seek clarity from the court," he said.
The decision from the European Commission fined Microsoft for failure to comply with an anti-trust decision, according to Neelie Kroes, the European competition commissioner.
It centres around the fact the Microsoft was selling royalty licenses at 3.8 per cent and information licenses at 2.98 per cent, which the commission deemed to be too high.
Microsoft subsequently agreed to reduce the rates to 0.7 per cent and 0.5 per cent respectively, for the European region.
Thomas Vinje, a partner specialising in competition and intellectual property at Clifford Chance, said the company would be better off complying to the agreement.
