The House of Lords has backed a move by the government to make recklessly losing data illegal.
If introduced, the amendment to the Criminal Justice and Immigration Bill will make it illegal to recklessly or intentionally release data on somebody.
The ruling will also apply to anyone who repeatedly of negligently discloses information.
It now must be backed by the House of Commons before the changes can be made.
The amendment was proposed by Baroness Miller, a Liberal Democrat MP, who dismissed claims that it should only apply to public sector workers, as the conservatives had suggested.
"If you are a member of the public it doesn't actually matter if it is the public or private sector that is losing your data. The fact is your data has been lost," she said.
The government was defeated last week when the amendment was approved with a margin of just four votes.
